These Terms of Service and Terms of Sale govern all relationships between JOALYS LTD and users of the Joalys platform. JOALYS LTD operates an e-commerce platform specializing in the sale of precious gemstones and luxury jewelry, offering two acquisition methods: direct sale and online auction system.

These Terms of Service and Sale aim to define the conditions under which Joalys offers its online sales services for precious gemstones and luxury jewelry, as well as the rights and obligations of the parties.

To make a purchase or participate in an auction, you must create a personal account on the Platform. Registration is reserved for persons of legal age (18 years or older) with full legal capacity.

Joalys offers an e-commerce platform dedicated to the sale of precious gemstones and luxury jewelry, offering two acquisition methods: direct sale at fixed price, and online auctions with ascending bid system.

We accept payments via Stripe (credit cards) and PayPal. All transactions are secure and PCI-DSS compliant. For auctions, payment must be made within 48 hours following the auction close. In case of refusal to pay customs taxes, the package may be blocked, returned, or destroyed, with no possibility of refund.

Joalys provides international deliveries subject to the availability of FedEx Express service and compliance with international sanctions.

The right of withdrawal applies differently depending on the acquisition method:

All Products sold by Joalys are accompanied by a certificate of authenticity issued by an independent and recognized gemological laboratory.

You benefit from a legal warranty of conformity of 2 years from delivery (standard UK/EU duration). In case of lack of conformity or hidden defect, you may require repair, replacement, price reduction, or cancellation with full refund. Warranties do not cover normal wear, damage from misuse, or unauthorized modifications.

Joalys is responsible for direct and foreseeable damages caused due to breach of its contractual obligations. However, Joalys disclaims all liability regarding customs duties, import taxes, customs clearance delays, package blocking or seizure by customs, and refusal of import for non-compliance with local regulations. The Buyer is solely responsible for informing themselves and complying with customs and tax obligations of their country.

All elements present on the Platform (texts, graphics, logos, images, photographs, videos, databases) are the exclusive property of JOALYS LTD or are subject to a license. These elements are protected by intellectual property laws. Any unauthorized reproduction, distribution, or commercial exploitation is prohibited and constitutes counterfeiting subject to civil and criminal sanctions.

The collection, processing, and protection of Users' personal data are governed by Joalys' Privacy Policy. By using the Platform, you acknowledge having read this Privacy Policy. You have rights of access, rectification, erasure, portability, and opposition regarding your personal data in accordance with GDPR.

You commit to using the Platform in accordance with these Terms, the law, and customs, and to respect third-party rights. Prohibited behaviors include: fraud, fictitious or collusive bids, identity theft, use of false documents, defamatory statements, unauthorized access attempts, and use of automated tools (scraping).

These Terms are governed and interpreted in accordance with English law (England and Wales). Any dispute will be subject to the jurisdiction of English courts.

These Terms, together with the Privacy Policy, constitute the entire agreement between Joalys and the User. If one or more provisions are declared null or unenforceable, the other provisions remain in full force. Joalys reserves the right to assign or transfer its rights and obligations, particularly in case of restructuring, merger, or acquisition.
